Cardage Terms of Service

Who these terms are with

Cardage is made and sold by Burning Hope Games LLC, a Washington limited liability company ("we", "us"). You can reach us at support@cardage.io. These terms, together with the privacy policy, cover the game at cardage.io and anything you buy there. If you get Cardage from another store, such as Steam, the App Store or Google Play, that store's terms cover the purchase, and these terms cover the rest.

Who can play

You must be at least 13 years old to sign in, post to the leaderboard or send wishes. To buy the full game you must be an adult where you live, or have a parent's or guardian's permission.

Your account

Signing in uses your Google account. You are responsible for what is done through it in the game. You can stop using the game at any time, and ask for your data to be deleted as the privacy policy describes.

The demo and the full game

The demo is free. It is all four heroes and the Graveyard, as far as the door to the Crypts. Everything past that door is the full game.

You get the full game by buying it, or by spending a code we give you. Either way it belongs to the Google account you are signed in with when you do, and it is there wherever you sign in with that account. We can't move it to another account.

Buying the full game gets you a personal, non-exclusive, non-transferable licence to play it for your own entertainment, for as long as we run it. You are buying the right to play the game, not the game itself.

Prices, payment and tax

The price is shown before you pay. Sales tax or VAT is included or added, depending on where you live, and shown at checkout.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the merchant of record for all our orders: you buy the full game from Paddle, under its buyer terms, and it takes the payment, charges the tax, issues the receipt and handles refunds, while we give you the game. We never see your card details.

We may change the price of the full game. That never changes what you have already bought.

Codes

A code is something we give: to a friend, a tester or a prize winner. It gives the full game to the first account it is spent on, and then it is spent. A code has no cash value, and may not be sold or exchanged for money. We may refuse a code that has been sold, stolen or published.

Refunds

If the full game isn't for you, you can have your money back within 14 days of buying it, for any reason, by writing to support@cardage.io from the email address on your receipt, or through Paddle, from the link on the receipt. A refund takes the full game back from the account. This is in addition to any right to cancel, or to a refund, that the law where you live gives you.

If a payment is reversed through your bank or card company, the full game is taken back from the account until the matter is settled.

Handles, scores and wishes

You may not use the leaderboard or wishes to:

• choose a handle that is hateful, sexual, harassing, pretends to be someone else, or contains someone's personal information
• send anything unlawful, threatening, harassing, or that you do not have the right to send (including pictures)
• post a score you did not earn by playing, whether by altering the game, its saves or its requests
• spam, or send advertising

We may change or remove a handle, remove a score, delete a wish, or stop an account from using the leaderboard and wishes, if we believe these rules have been broken.

What you send us

What you write in a wish, and any picture you send with it, stays yours. By sending it, you let us store it, read it and reply to it. Wishes are suggestions: if you suggest an idea, we are free to use it in the game without owing you anything for it.

Leave the game in one piece

Please don't try to break into, overload or disrupt the game or its servers, get around its limits or the door between the demo and the full game, or collect data from it by automated means. Modding or tinkering with your own copy for your own fun is fine, as long as the results stay off the leaderboard.

The game belongs to us

Cardage, including its code, art, music, voices, story and name, belongs to us. You may play it, and share screenshots and videos of your play, including on streams and in videos you earn money from. You may not copy, sell or redistribute the game or its files, or pass on what opens the full game to anyone who has not bought it.

The game can change

We will keep working on the game, and may change, add or remove things in it, and reset the leaderboard. The game runs on a best-effort basis and may sometimes be unavailable. If we ever decide to stop running the full game, we will say so on this site at least 30 days before we do.

Ending access

If these terms are broken, we may stop an account from using the leaderboard and wishes. We take the full game back from an account only for a refund, a reversed payment, a code that should not have been spent, or fraud.

No guarantees

Apart from what these terms promise, the game is provided "as is" and "as available", without warranties of any kind, express or implied, including that it will be free of errors, uninterrupted, or fit for any particular purpose. Your progress is kept in your browser, and with your account if you sign in; progress kept only in a browser can be lost, for example if its data is cleared. Nothing in these terms takes away a right you have as a consumer that the law does not let us exclude.

Limit of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special or consequential damages, or for any loss of data or saved progress, arising from your use of the game. Our total liability for any claim relating to the game is limited to the greater of the amount you paid for it in the twelve months before the claim, or 10 US dollars. Some places do not allow these limits, so they may not all apply to you.

The law that applies

These terms are governed by the laws of the State of Washington and of the United States, without regard to rules on conflicts of law, and disputes about them belong to the state and federal courts located in Washington. If you are a consumer living in the European Union, the United Kingdom or another country whose laws protect you whatever a contract says, you keep that protection, and you may also bring a claim in the courts where you live.

Changes to these terms

If these terms change, this page will be updated and the date at the top changed. If you keep playing after that, you accept the new terms. A change never takes the full game away from someone who has already bought it.
